Anea Terms and Conditions

Welcome to Anea! These Terms and Conditions ("Terms") govern your use of our website located at www.Anea.art ("Website") and our services, so please carefully read them before using our services.
1. Introduction
By using our Website and services, you agree to these Terms. If you don’t agree to these Terms, you may not use our Website or services. We may modify these Terms at any time, and if we do, we will notify you by posting the modified Terms on our Website. It's important that you review any modified Terms before you continue using our Website or services.
1.1
These general terms and conditions (the “General Conditions”) apply when you as a consumer (the “Customer”) place an order via www.Anea.art and related pages, (the “Website”). The agreement is concluded between you and Anea, company reg. no. DK43584162. Detailed contact information and other information about Anea are set forth on the Website. The General Conditions are only applicable to Customers that are consumers.
1.2
The Customer must be minimum 18 years old to order via the Website. Anea does not, in accordance with Danish Law, accept any credit purchases to persons below 18 years of age. Anea reserves the right to deny or change a Customer’s order (e.g. if the Customer has provided incorrect personal data and/or has any record of non-payment of debt).
1.3
Anea shall have no liability in case products are sold out, nor for image or typographical errors on the Website, e.g. errors in the product description or technical specification, inaccurate prices and price adjustments (such as changed prices from suppliers, change in currencies) or incorrect information with regards to whether a product is in stock. Anea is entitled to rectify any such errors and, at any time, to change or update the information. If an inaccurate price has been stated for a product ordered by the Customer, Anea will naturally notify the Customer accordingly and await the Customer’s approval of the amended price prior to Anea continuing with the order process. All images on the Website shall be considered solely as illustrations. Such illustrations do not guarantee to reproduce the exact appearance, function or origin of the product. Anea is not responsible for any information by third parties provided for on the Website.
1.4
The Website and all its content is owned by Anea or its licensors. The information is protected by intellectual property and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout and information about products, services and other content may not be copied or used without the prior written consent of Anea.
2. Orders
2.1
In order to place an order through the Website, the Customer must accept the General Conditions. By accepting the General Conditions, the Customer undertakes to comply with the General Conditions in its entirety and acknowledges that he/she has read the information on personal data and cookies and consents to the use according to Anea’s Privacy Policy set forth here.
2.2
A purchase agreement is concluded when Anea has confirmed the Customer’s order and the Customer has received an order confirmation from Anea via e-mail. Anea encourages the Customer to save the order confirmation for any future contacts with Anea’s customer service regarding the order. Due to the custom nature of the orders, the Customer is not entitled to cancel its order once it has been confirmed by Anea. Anea reserves the right to accept or reject your order for any reason.
3. Customer Information etc.
3.1
When the Customer registers their user account and/or places an order, the Customer will be requested to provide some personal data. The Customer confirms that the information provided is correct and complete and is responsible for any errors in the information provided. Information about Anea’s processing of personal data is set forth in Anea’s Privacy Policy, which constitutes an integral part of these General Conditions.
3.2
The Customer undertakes to ensure that no one, except the Customer, uses the Customer’s log-in details. The Customer may not disclose its username or password to any person and shall ensure that any documentation with information about username and password is kept in such a way that unauthorized persons may not access the information. The Customer shall notify Anea without delay if it may be suspected that any unauthorized person has obtained access to the Customer’s password. The Customer is responsible for all purchases made with the Customers log-in details if the Customer has not provided such notification.
3.3
If Anea suspects that the Customer abuses its user account or its log-in details or otherwise violates the General Conditions, Anea is entitled to block the Customer’s access to its user account. Anea is furthermore entitled to assign new log-in details to the Customer.
4. Prices and Fees
4.1
The prices stated on the Website apply to orders placed on the Website. All prices are presented in € (Euros) and do not include payment and shipping fees, which are given separately. 25% VAT is included in the product price for the EU countries. Any extra taxes or duties that may be applicable upon delivery will be the responsibility of the buyer.
4.2
The Customer can pay for their purchase in the manner specified on the Website. Read more about our different payment options and discounts in our FAQ or Help Page. Anea is entitled to charge the Customer already in connection with the order. Anea reserves the right not to offer all payment methods at all times, alternatively change payment method if the payment method the Customer has selected does not work, for whichever reasons, at the time of fulfillment of the order. Please note that limitations of available payment methods are set forth on the Website.
5. Special offers
Anea may from time to time provide special offers or discounts on the Website which may have more favourable conditions than those set forth in these General Conditions, e.g. with regard to payment or extended right of withdrawal. Such conditions will apply for the duration of the special offer and for the specific products set forth by Anea in connection therewith. Anea reserves the right, at any time, to withdraw such special offers. Upon termination or withdrawal of a special offer, these General Conditions shall apply without any amendments. Any offers on specific products on the Website are valid only for a limited period of time and until products are sold out.
6. Gift Cards
Gift certificates sold on Anea are valid for two (2) years from the date of issue and can be redeemed at Anea’s webshop. After the expiration date, the certificate cannot be used as a method of payment, cannot be reactivated, and any remaining balance cannot be refunded. Your gift certificate should be kept in a secure place, and cannot be redeemed for cash. Lost or stolen certificates will not be replaced.
7. Competitions
7.1
To participate in any competition provided by Anea, you must be aged 18 and over. Employees at Anea cannot participate in any competition held by Anea.
7.2
The winner will be selected by an independent jury from our marketing department. Full details of the judging process and the names of the members of the jury are available on request by emailing hello@Anea.art. The jury's decision cannot be appealed. When choosing the winner, the jury will be looking for the best contribution (whatever it might be, depending on the competition).
7.3
The winner will be announced on our social media where the competition is being held and asked to contact us for further information. The prizes cannot be exchanged, transferred or returned and cannot be redeemed by you for cash or any other prize. You must pay all other costs associated with the prize and not specifically included in the prize. We retain the right to substitute the prize with another prize of similar value in the event that the original prize offered is not available.
8. Delivery and shipping
8.1
Products are normally delivered within the number of working days set forth on the Website. The expected time to produce the jewellery is 1-4 weeks from when the order is made. Shipping usually takes between 1-7 days, depending on the customer's location. Anea is not liable for any damages that may occur during shipping. If you haven't received your order within the delivery time advertised, please contact our Customer Service no longer than 40 working days after the order was placed. Unless otherwise expressly agreed and if a delivery is delayed for more than 30 working days (from date of shipping) and it is not due to you as Customer, you are entitled to cancel the purchase.
8.2
All orders are delivered directly to the address provided by the Customer. The Customer will receive a notification of delivery stating when the package has been shipped. The notification may be made by e-mail, ordinary mail and if the Customer has provided a mobile number, also by phone or SMS. Anea is not responsible for packages that are not received due to incorrect address information or unavailability of the recipient at the time of delivery.
9. Right of withdrawal
9.1
Due to the custom nature of the orders, Anea does not offer returns or exchanges. This includes, but is not limited to, the following situations:
- If the customer changes their mind after placing the order.
- If the customer is not satisfied with the final jewelry piece due to subjective reasons (e.g., they don't like the style, design, or they don't think the jewelry matches their expectations).
- If the final jewelry piece is damaged during shipping (as Anea is not liable for any damages that occur during shipping).
9.2
By accepting the General Conditions, the Customer acknowledges and agrees that the right of withdrawal is not valid for any digital content delivered otherwise than by a tangible medium.
9.3
In connection with ordering a product for which the right of withdrawal does not apply, the Customer will receive clear information. If a product has been sealed, the Customer may not break the seal if the Customer wishes to utilize its right of withdrawal. The right of withdrawal ceases accordingly when the Customer breaks the seal. A seal shall also include any technical seal (e.g. serial number).
9.4
If the Customer wishes to withdraw a purchase, the Customer shall, prior to the expiry of the withdrawal period, send a clear message to Anea in the manner set forth here. The Customer shall provide their name, address and other relevant information, e.g. order reference, invoice number and the name of the product in the message. If the Customer prefers not to use the above alternative message, the Customer may use the standard form for the right of withdrawal provided by the National Board for Consumer Policies or any other equivalent authority in their respective country.
9.5
When exercising the right of withdrawal, the Customer pays a return shipping fee and is responsible for the condition of the product after the Customer has received the product and during the return shipping. The product shall be returned within 14 days from the date when Anea was notified of the withdrawal. The product shall be sent well packaged, in good condition and in its original box. Any returns shall be sent to Anea in accordance to the methods and instructions stated on the Website.
9.6
When the Customer withdraws its purchase, Anea will refund the amount the Customer has paid for the product, including shipping costs. Any additional shipping costs due to the Customer choosing another delivery than the standard delivery offered by Anea are exempted from refund. Upon return of part of an order, the shipping costs will not be refunded. Anea is entitled to deduct an amount from the amount to be refunded, which corresponds to the depreciation in value of the product compared to the original value of the product, if and to the extent such depreciation in value is due to Customer having handled the product to a greater extent than necessary to determine its function or characteristics.
9.7
Anea will pay back the amount without undue delay, however, no later than within 14 days from the date Anea received the Customer notification of withdrawal. However, Anea may delay repayment until Anea has received the product or the Customer has provided proof that the product has been returned, e.g. by means of certificate of delivery. Repayment will be made to the Customer by the payment method chosen by the Customer, unless otherwise agreed or if there is any objection for such a repayment.
10. Links
Anea may provide links to other websites beyond the control of Anea and websites beyond the control of Anea may provide links to the Website. Even if Anea attempts to ensure that Anea only provides links to websites which apply similar personal data and security provisions pursuant to Anea’s Privacy Policy, Anea is not responsible for any protection or confidentiality of information or personal data which the Customer provides on other websites. The Customer should be cautious and read the personal data provisions applicable to the actual website.
11. Force majeure
Anea is not liable for any delays caused by circumstances beyond Anea’s control, e.g. general labour dispute, acts of war, fire, lightning, terrorist attacks, changed governmental orders, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above. Such circumstances shall result in relief from damages and other measures. If any such situation should arise, Anea shall inform the Customer accordingly both at the beginning and the end of the period for the current situation. If the situation has lasted for more than two months, both the Customer and Anea are entitled to terminate the purchase with immediate effect.
12. Changes to the general conditions
Anea reserves the right to change these General Conditions at all times. Any changes to these General Conditions will be posted on the Website. Changes will become valid once the Customer has accepted the General Conditions (in connection with a new purchase or while browsing the Website), alternatively 30 days after Anea has informed the Customer of the changes. However, Anea recommends that the Customer regularly remains updated on the Website in order to become aware of any changes to the General Conditions.
13. Severability
If any provision of this Agreement is held to be invalid or unenforceable by any competent court, authority or arbitral tribunal, the remainder of that provision and all other provisions will remain valid and enforceable to the fullest extent permitted by applicable law. Any provisions determined invalid or unenforceable will be substituted by relevant legal guidance and advice.
14. Payment
Payments are handled securely by Stripe. Payments are withdrawn immediately once the order is made. The payment is then withheld at Stripe until the jeweler completes and ships the order. Once the order is shipped, the jeweler will receive the payment payed during shipping (as Anea is not liable for any damages that occur during shipping).
15. Warranties and Complaints
Anea is committed to providing high-quality services. However, if there is a problem with the order that is directly attributable to Anea (e.g., the wrong jewelry piece was sent), then the customer should contact Anea's customer service for assistance.
16. Intellectual Property Rights
All intellectual property rights to the AI-generated jewelry designs remain the property of Anea. You as a customer get a personal license to the physical jewelry piece, but Anea will retain all commercial rights. This means that while customers own the physical jewelry piece for personal use, they are not permitted to reproduce, distribute, or commercialize the design in any form without the express written consent of Anea.
17. User-Generated Content
Anea cannot ensure or check if the customer infringes on Copyright or IP infringement, or produces inappropriate content. If Anea receives an order that clearly infringes, it reserves all rights to cancel the order and provide a refund. It is the customer's responsibility to ensure that there are no copyright infringements for uploaded images. For the Anea jewelry design generator, there are no copyright infringements, and the customer is safe to generate the designs they want.
18. Jeweler Collaboration
Payments for orders are transferred to Stripe and held there until the jeweler ships out the order. Once the order is shipped, the jeweler is paid. This process protects both the customer and the jeweler, ensuring that the jeweler is incentivized to deliver quickly and the customer receives their order as expected.
